These Terms of Service (“Terms”) are crucial as they oversee your interaction with our website at https://eazycaptions.com, managed by Derest.

Your use of our Service is also contingent upon your compliance with our Privacy Policy, which outlines the procedures we follow to gather, safeguard, and disclose information about your use on our websites. Please review it here.

The "Agreements" that you are engaging into with us are these Terms plus our Privacy Policy taken together.

You agree that you have read, understood, and accept these Agreements by using our service. You are sadly unable to utilize our Service if you find yourself unable to agree with (or comply with) these Agreements. For possible solutions, we do, however, invite you to contact us at fpalacios@eazycaptions.com. Any visitors, users, and other individuals who access or use our Service are subject to these Terms.

2. Interactions and Communications

You agree to receive newsletters, marketing, promotional materials, and other information from us when you create an account with our service. If you would like to stop receiving these emails, you may use the unsubscribe link or send us an email at fpalacios@eazycaptions.com.

3. Purchases

In order to complete a Purchase ("Purchase") using our service, you might be required to supply certain facts related to your Purchase, such as your credit card number, expiration date, billing address, and shipping information, among other things.

You certify that the information you provide us is true, correct, and up to date, and that you are legally permitted to use any credit card(s) or other payment methods for your purchase.

Third-party services are used by us to process payments and finish purchases. You give us permission to share your information with these third parties in accordance with our privacy policy by entering your information.

For a number of reasons, including but not limited to: product or service availability; inaccuracies in product or service descriptions or prices; order errors; payment defaults; or other reasons, we retain the right to reject or cancel your purchase.

If we believe there has been fraud or other unauthorized or unlawful transactions, we also have the right to cancel your order.

4. Subscriptions

We offer some portions of our Service via a subscription model (referred to as "Subscription(s)"). Depending on the subscription plan you have selected, payments are billed in advance on a recurring, periodic basis (referred to as the "Billing Cycle"). This billing cycle may occur monthly or annually.

Unless you cancel it or Derest cancels it, your subscription will automatically renew under the same terms at the conclusion of each billing cycle. You can contact the Derest customer service team or cancel your subscription renewal using your online account management page.

Process payments for your membership only if you have a working payment method (credit card, for example). Accurate and comprehensive billing data, such as your full name, address, state, zip code, phone number, and a working payment method, must be sent to Derest. You give Derest permission to charge your payment method for all incurred Subscription fees by submitting this payment information.

Derest will send an electronic invoice requiring manual payment within a given deadline, which corresponds to the billing period provided on the invoice, if automatic billing is unsuccessful.

If you qualify for a discount, please be aware that it will only apply once per subscription.

5. Free Trial

At its sole discretion, Derest may provide a limited-time free trial of a subscription (the "Free Trial").

Registering for the Free Trial requires providing billing information.

Derest won't charge you while you're using their free trial. On the last day of the Free Trial, however, you will be automatically charged the corresponding Subscription fees for the plan you have chosen, unless you cancel your Subscription. Derest reserves the right, at any moment and without prior notice, to alter or terminate the Free Trial offer.

6. Modifications to Fees

Derest retains the sole right to change the Subscription prices. After the current Billing Cycle concludes, any modifications to the subscription fees will become effective.

Any changes to the subscription prices will be communicated to you in advance so that you have time to cancel your subscription before the new terms take effect.

Your acceptance of the revised fee amount is indicated by your continued usage of the Service following a change in the subscription cost.

7. Refunds

All yearly and monthly payments are not refundable. Anytime you open your control panel, choose the Billing page, and click Manage Subscription, you can end your subscription. At the conclusion of the current payment period, the cancellation will take effect.

8. Content

You can upload, link, store, distribute, and make available different kinds of text, images, videos, and other content (collectively, "Content") using our service. The legitimacy, dependability, and suitability of the Content you upload on or through the Service are entirely your responsibility.

Inappropriate content includes but is not limited to hate speech, nudity, and illegal activities.

By uploading Content, you represent and warrant that: (i) you are the owner of the Content or that you have permission to use it, and that you have granted us the rights and license described in these Terms; and (ii) your Content does not violate the rights of any person or entity with respect to privacy, publicity, copyrights, contracts, or other rights. If someone is proven to be violating copyrights, we reserve the right to cancel their account.

Any Content you upload, publish, or display on or through the Service is still your property, and you are in charge of preserving those rights. Any Content posted by you or any other third party is not our responsibility. On the other hand, you give us permission to use and distribute the Content you publish on and through the Service, including the right and license to alter, adapt, perform, display, and reproduce it publicly. We may distribute your Content to other Service users with this license, and those users may use it in accordance with these Terms. Derest is free to monitor and alter any user-provided content, but this is not required.

Send an email from the address associated with your account to fpalacios@eazycaptions.com explicitly expressing that you do not wish Derest to utilize your content. We reserve the right to utilize your Content for promotional case studies in the absence of this opt-out.

9. Illegal Usages

The usage of the Service must comply with these Terms and be done legally.

You consent to not using the service:

(a) In a way that violates any local, state, federal, or foreign law or regulation that may be in force. (b) To take advantage of, injure, or seek to injure or exploit minors in any manner, including by exposing them to offensive material. (c) Sending, receiving, uploading, downloading, using, or reusing any content that doesn't adhere to our content guidelines. (d) To send unsolicited or unlawful advertising, promotional materials, or any other kind of comparable solicitation, or to arrange for the distribution of such materials (spam). (e) To pretend to be Derest, an employee of Derest, a different user, or any other individual or organization. (f) In connection with any unlawful, illegal, fraudulent, or harmful purpose or conduct; in any manner that violates the rights of others; or in any manner that poses a threat to law enforcement or other authorities.

Moreover, you commit to refrain from:

(a) Make use of the Service in a manner that would disrupt other users or harm, disable, overload, impair, or undermine our security or systems. (b) Gather, harvest, or attempt to decode any transmissions to or from the servers hosting the Service, as well as any information or data from the Service or our systems. (c) Use any automated system to access the Service in a way that sends more request messages to the Derest servers than a human could reasonably create in the same amount of time by using a standard online web browser. This includes, but is not limited to, robots, spiders, offline readers, or similar. (d) Gain unauthorized access to, interfere with, damage, or disrupt any portion of the service, any network or equipment used to store the service, any software used to provide the service, or any third-party software, equipment, or network.

10. Analytical

Third-party service providers may be hired by us to keep an eye on and evaluate how our service is being used.

Google Data Google offers a web analytics tool called Google Analytics that monitors and reports website traffic. Google tracks and keeps an eye on how our service is being used. Other Google services might receive access to this information. Google may utilize the information gathered to contextualize and tailor its own advertising network's advertisements.

11. No Use By Minors

The Service is only meant for users who are eighteen (18) years of age or older. You represent and warrant that you are at least eighteen (18) years old, have the legal authorization, right, and capacity to enter into these Terms, and that you will abide by all of the terms and conditions set forth by accessing or using any of Derest's services. You are not permitted to access or use the Service if you are not at least eighteen (18) years old.

12. Accounts

You must at all times verify that the information you provide about yourself is true, full, and up to date when creating an account with us. You must also be over the age of 18. Your account on our service may be terminated immediately if you do not submit accurate, full, and current information.

It is your responsibility to keep your password and account private, which includes, but is not limited to, limiting access to your computer and/or account. Whether your password is for our service or one of our partners, you acknowledge that you are accountable for all activities or decisions made using your account and/or password. In the event that you become aware of any security breach or unauthorized use of your account.

In case of unauthorized access to your account, immediately notify our customer support. Failure to maintain the accuracy of your account information may result in account termination

Account sharing is not allowed.

It is prohibited for you to use as a username the name of any other person or organization that is not allowed to be used, a name or trademark that is protected by any rights of someone else other than you without the proper consent, or a name that is derogatory, vulgar, or pornographic.

At our sole discretion, we reserve the right to reject service, delete or modify material, cancel orders, and terminate accounts.

Derest and its licensors own all rights to the Service, including all of its original content (apart from user-provided material), features, and functionality. The copyright, trademark, and other laws of USA and other nations protect the Service. Without Derest's prior written approval, our trademarks and trade dress may not be utilized in conjunction with any good or service.

14. Amendments to the Terms

We reserve the right to modify or update these Terms at any time. Such modifications will be effective immediately upon posting the revised terms on our website. We will make reasonable efforts to notify users of any significant changes to these Terms, either through a prominent notice on our website or via email. Your continued use of our Service after such modifications will constitute your acknowledgment of the modified Terms and your agreement to abide and be bound by the modified Terms.
